After a careful reading of the census laws, I have worked out a major
loophole in this years' laws. Due to 2001 being the centenary of
federation, the govt has introduced a new census law to deal with the
census question "Do you wish to have your records kept and released
after 99 years?".
This law states (paraphrased) "that no person may, for any reason
or under any threat, inducement or promise, even under legal order
issued by court, release any information pertaining to the 2001
census for a period of time no less than 99 years."
Basically, if the ABS attempts to fine anyone for deliberately
provideing a false or misleading statement on their census, all that
person need do is take the fine to court. The laws in Australia
provide for innocence until proven guilty, and the ABS is then forced
to provide proof that you gave a false or misleading statement. The
only way they can provide that proof is to reveal your census
answer....effectively breaking their own law preventing anyone from
revealing any information regarding the 2001 census for at least 99
years.
